Terms and Conditions of Service

- BACKGROUND
These Terms and Conditions of Service (the “Agreement”) is a binding contract between Karaoke Party Box (Gutenburg Sp. z o.o.), NIP 7010869594, KRS 0000750859, REGON 381430320, the karaoke establishment located at al. Jana Pawła II 45A/47, 01-008 Warszawa, registered at ul. Lechicka 25a in Warsaw (the “Company”).
and
the entity that receive services provided by the Company under the Agreement (the “User”) .
By accessing karaokepartybox.eu (the “Website”) or making any purchase from the Company, the User indicates the acceptance of this Agreement. Additional terms and conditions may apply to additional areas of the website or to particular negotiations or content posted on the site, in conjunction with the actual Terms and Conditions of Service Agreement.
- SERVICES OF KARAOKE PARTY BOX AND WEBSITE USE
a. Karaoke Party Box provides certain services, including karaoke rooms renting, alcohol, liquor and other beverage offerings (collectively, the “Services”). The Services may be purchased in advance online through karaokepartybox.eu.
b. The prices given on the Website are in Polish zlotys and are gross prices (including VAT).
c. Use of the Website is voluntary.
d. Creation of an account on the Website is free.
e. Browsing the Website does not require creating an account. The customer can place an order for the products listed on the Website after creating an account, or without creating an account by providing the necessary personal and address data to carry out the order.
- SERVICE DELIVERY
The delivery of the Services is based on the date and duration the user scheduled. The user shall present at the physical karaoke establishment of Karaoke Party Box to consume the Services.
- PAYMENTS
a. The user is able to pay for the Services online via:
- Credit card / Debit card
- Paypal
- PayU
- Przelewy24 (P24)
b. The user also able to pay for the Services on-site at the karaoke establishment located at al. Jana Pawła II 45A/47, 01-008 Warszawa, with cash (PLN/EUR) or card payments.
c. Discounted prices are only applied to online payments.
- REFUND
- For the bookable products listed on the Website, by paying online,
i) the User is eligible for a full refund without giving a reason up to 10 hours before the booked time.
ii) If the User cancels the reservation within 10 hours of the booked time, the User will be charged a cancellation fee of 40 pln.
iii) Refund will be processed within 5-7 business days. Refunds can only be sent back to the original payment method used in a charge.
iv) It is non-refundable if the user does not show up at the booked date. The booking can be held for rescheduling and the User will not be charged for rescheduling bookings.
v) If the User arrives late more than 15 minutes after the booked time, Karaoke Party Box reserves the right to delay the booking time for other awaiting customers.
- By paying with cash or card payments at the store, the User is not eligible for any refund whatsoever for any reason at any time. If the User arrives late more than 15 minutes after the booked time, Karaoke Party Box reserves the right to delay the booking time for other awaiting customers.
- For the non-bookable products listed on the website, such as gift vouchers, the User is eligible for a full refund without giving a reason up to the expiry date. It is non-refundable after the expiry date.
- COMPLAINTS
a. The User may contact the Company regarding the services provided in accordance with this Agreement in the following:
i. Address for writing: Karaoke Party Box, ul. Lechicka 25a, 02-156 Warszawa.
ii. Electronic method: booking@karaokepartybox.eu
b. Karaoke Party Box may contact back to the User in the following ways:
i. In writing to the mailing address specified by the User.
ii. Send electronically to the email address specified by the User.
iii. Dial the phone number specified by the User.
c. If the User believes that the Service provided by the Company was performed in violation of the terms of this Agreements, he can file an objection (complaint) by the method specified above. Complaints may be submitted electronically or in paper form. Complaints should contain at least the User's displayed name on the Karaoke Party Box (logged-in users), a description of the objection raised, and a description of the proposed resolution of the complaint.
d. The Company shall consider the complaint within 14 days from the date of receipt of the complaint. If the complaint does not contain the information required for consideration, the Company will ask the person who submitted the complaint to supplement it to the extent necessary and 14 days will be counted from the date of delivery of the supplementary complaint.
e. Replies to complaints are sent only to the email address assigned to a given user account. In particularly reasonable cases, the company may send a reply to another e-mail address specified by the person who submitted the complaint, which is not assigned to the user account, or in writing to the address specified in the complaint.
f. As part of a complaint (appeal), the User has the right to appeal a decision made by the Company. The terms of 2,3,4 in this section shall apply mutatis mutandis.
- PERSONAL DATA
a. The administrator of the User's personal data collected via the Website is the Company.
b. The User’s personal data collected by the administrator via the Website are collected in order to implement the Service, and if the User agrees - also for marketing purposes.
c. If the Users pays online, the administrator required to provide the User’s collected personal data to the selected entity servicing the above payments on the Website.
d. The User has the right to access their data and correct them.

- GENERAL TERMS
a. Karaoke Party Box reserves the right to correct any errors or inaccuracies in the content on the website, or to change and update the content at any time without giving prior notice.
b. For matters not covered by this Regulation, the generally applicable provisions of Polish law shall apply, in particular: Civil Code; Act on Provision of Electronic Services; Consumer Rights Act, Personal Data Protection Act.
